ARTHEMEA - Residences et hotels

SPECIFIC SALES CONDITIONS

1 - RESERVATION :

All reservations must be accompanied by a payment that includes :
- an administration fee of 10 € per reservation for all holidays lasting 4 nights or less and 15 € for all holidays lasting 5 nights or more
- a deposit of
     - 25 % of the full price of your holiday,
     - 100 % of the insurance premiums due on any policies that you decide to take out.
The deposit must be received within 5 calendar days of the reservation being made by telephone.

From the date that the administration fee and the deposit are paid until 31 days prior to the holiday, client has the right to cancel. In the event that client uses this right, the amount of deposit paid will be refunded to them after deducting the 10 € or 15 € administration fee, depending on the length of the holiday. The total cost of insurance is payable upon reservation and is non-refundable.
The full price of the rental must be paid 30 days before the start of the holiday. For reservations made less than 30 days before the date of departure, the client must pay the full price when making the reservation. If the client has not paid the balance within the specified deadlines and has not used the right to cancel, Arthéméa reserves the right to consider the sale as completed from the30th day prior to the start of the holiday and, as a consequence, the cancellation conditions specified herein will become applicable. Client's commitment therefore becomes definite upon payment of the outstanding balance at least 30 days prior to their holiday, or, in the event that the balance is not paid and the holiday is not cancelled, from 30 days prior to their holiday. Anyone who arrives for the departure of a holiday or at the accommodation without having first paid the outstanding balance will be refused access to the journey or accommodation. Arthéméa is definitely committed before the 30th day prior to client's holiday upon receiving confirmation of the reservation (deposit + administration fee + insurance premiums, when due).

NOTE: Payments can only be made by credit or charge card, American Express, cheque or electronic transfer.
Payment by foreigners can only be made by credit or charge card, Eurocheques or a cheque in euros.

2 - PRICE :

Our prices are tax inclusive and include the availability of the accommodation and utilities (water, electricity, heating) but exclude administration charges, which are payable upon reservation, the taxe de séjour, which is payable on arrival, fees for domestic pets and premiums for optional insurances.

3 - «TAXE DE SÉJOUR» :

The "taxe de séjour" (vacation tax) may be deducted either as a fixed amount or as a proportion depending on the local authority. Where the proportional method is used, client will be required to pay it upon arrival; where the fixed fee applies, the tax is included in the tax inclusive price of your rental.

4 - CHANGES or CANCELLATION BY THE ORGANISER :

The times and programmes contained in our literature may be changed due to circumstances beyond our control or which are imposed on us by decisions made without warning by our local suppliers and service providers. When, prior to the client's rental, we are obliged to make a change to one of the main parts of the contract, after having been advised by registered letter with reception receipt, the client may :

- Either cancel the contract and receive an immediate refund of the amounts paid without deduction;
- or accept the change or an alternative stay proposed by the vendor; an appendix to the contract specifying the changes will then be signed by both parties; any reduction in the price will be deducted from any outstanding balance that is due by client and, if the payment already made is greater than the new offer, the excess will be refunded prior to the departure date

Client can claim no compensation if we are obliged to change or cancel one of the main parts of the contract due to a major force or for security reasons during the holiday.

5 - CHANGES, CANCELLATION OR INTERRUPTION BY THE CLIENT :

CHANGES :
We will use our best efforts to accept requests for changes to dates, apartment types or places of stay within the limits of availability. If the cost of the reservation (excluding optional services) after the changes is less than the cost prior to the changes, we will retain a 10 € modification fee.

CANCELLATION :
In the event of cancellation, client must notify us by registered letter with a reception receipt and the date of reception is the cancellation date.

If client advises us more than 30 days prior to the start of their holiday, we will retain the initial administration fee of 10 or 15€ (depending on the length of the holiday) and any insurance premiums that have been paid

If client advises us less than 30 days prior to the start of stay, we will retain the initial administration fee of 10 or 15€ (depending on the length of the holiday) and any insurance premiums that have been paid to which will be added the following amounts :
- 30 to 15 days inclusive prior to the start of the holiday: 25 % *
- 14 to 8 days inclusive prior to the start of the holiday: 50 % *
- less than 7 days prior to the start of the holiday or failure to arrive at the place of stay: 100 % *

* of the total cost of the holiday.

This cancellation may be due to a force majeure and we recommend that you take out an insurance policy agreed with Elvia Assurances Voyages (see Article 13 - Insurances). Insurance premiums must be paid in full at the time of reservation and are never refunded

INTERRUPTION :
No refund of any sort is made if a holiday is interrupted or shortened by client for any reason whatsoever.

6 - ARRIVAL AND DEPARTURE :

Keys will be available from 17h00 on the day* of arrival. Keys must be returned by 10h00 on the day* of departure. * Saturday in most cases.

7 - DAMAGES DEPOSIT :

Client will be required to pay a damages deposit of 250 € per apartment, bedroom, villa or house upon arrival. It will be returned at the end of the stay after payment of any additional services that have been used (telephone, parking...) and deduction of compensation for any damage caused.

8 - ANIMALS :

Domestic pets are accepted provided they have a rabies vaccination certificate.

9 - HOUSE RULES :

House rules are posted in each apartment. We ask clients to read them and respect them.

10 - RÉCLAMATIONS :

ny complaint that may arise during the stay must immediately be brought to the attention of the site manager and an incident form should be completed in order that we can resolve the problem as quickly as possible. If it cannot be resolved on site, the client should send us a letter within 28 days of their arrival providing details of their complaint. Claims made after this deadline will not be accepted.

11 - RESPONSIBILITY :

We would like to make you aware that renting in a Résidence de Tourisme (tourist residence) is not subject to the rules related to hotel owner's responsibility. Consequently, Arthemea is not liable in the event of loss, theft or damage to personal effects in our residences, whether in the apartments, the car parks or the communal areas.

12 - JURISDICTION :

Any disputes will be judged by the competent courts.

13 - INSURANCES :

We can take out a cancellation insurance policy with Elvia Assurances Voyages on client's behalf. This insurance takes effect on the day that the reservation is made with Arthéméa or at noon the day following payment of the premium if the policy is taken out after the reservation. It must be taken out before the date at which cancellation charges come into effect.

16 - MISCALLEANOUS :

Photographs used in documents and communication materials are for illustration purposes only and the client will not necessarily be housed in the building shown. The client may not make any claim against Arthéméa in respect of the description of the accommodation.
